This agreement applies to you the user of this website Elite Bespoke Planters LLP, the owners of this website. If you do not agree to be bound by these Terms and Conditions, you should stop using the website immediately.
“Buyer” means the person or company who accepts the Sellers quotation for the sale of the Goods or whose Order for the Goods is accepted by the Seller.
“Seller” means Elite Bespoke Planters LLP (trading as EBPlanters.co.uk) Company No.OC389419 and whose registered office is: Agincourt Practice LTD, 6 Agincourt Street, Monmouth, Monmouthshire NP25 3DZ.
“Goods” means the goods (including any instalment of the goods or any parts for them) which the seller is to supply in accordance with these terms.
“Order” means the buyers acceptance of the sellers quotation for the goods or the order placed by the seller for the goods whether by means of the seller’s catalogue or website which the buyer accepts.
“Customised Products” means any products ordered by or supplied to the buyer which have been either custom made or ordered from a third party or tailored to meet specific requirements stipulated by the buyer. Other terms used for this could be Bespoke or personalised.
“Non-Customised Products” means any product, which are not customised products also known as standard stock product.
“Terms” means the standard terms of sale set out in this document and includes any special terms agreed in writing between the seller and the buyer. These terms govern the sale of the goods sold by the seller to the buyer named on the order form provided on the seller’s website or catalogue and where the goods are supplied as a result of the buyer acceptance or the quotation. The completed order form or quotation together with the terms constitute the entire and only agreement between the parties in relation to the sale of the goods and comprises a legally binding contract between the parties.
“Website” means the website you are currently using ebplanters.co.uk and any sub-domains of this site.
EB Planters use only genuine stone (including but not least) marble, granite, travertine, limestone, slate, onyx, serpentine etc. We take great care to source from reputable suppliers and quarries from all over the world, and select only the best quality stone. Sometimes a particular stone may be out of stock with our suppliers meaning we will not be able to fulfil certain orders where these stone types are requested. We will let you know if this is the case as soon as we find out, offering an alternative, or a refund, if you have already paid for it.
EB Planters use only authentic stone which is an organic and integral part of the earth. It has been in the ground for thousands of years and has individual markings which makes each piece unique and unlike any other. This means the item you receive will not look identical to a photograph you may have seen on the website, unless it is being sold as the specific item on display.
The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.
The goods are described on our website and the customer shall at all times ensure that the terms of any order and any applicable specifications are complete and accurate. Contact: ebplanters.co.uk if in doubt. Details are on the website.
The price of the goods is payable upon the placing of an order. EB Planters accepts most major cards. If the customer does not wish to pay on-line they may make a payment by cheque to: Elite Bespoke Planters LLP, The Granary, Little Wonastow Rd, Monmouth, Monmouthshire NP25 4DW. Or by online bank transfer via phone or in writing, including email communication.
Unlike larger companies EB PLanters do not hold a massive stock. We will aim to fulfil any orders as soon as possible, depending if we have the item requested in stock or it is that we have to manufacture it for you. If it is the latter it will obviously take longer so all of our order times will have to be discussed with you at the time of the order. We always suggest phoning us or sending us an email if you are not too sure about anything while thinking about placing an order. If you are in a hurry then we definitely suggest contacting us first before placing an order.
*Bespoke or Custom made items are only ever paid for after discussion with EB Planters about what it is you require.
Any dates quoted for delivery are approximate only. EB Planters aim to deliver the goods within an order within 1-4 weeks of communicating acceptance of an order but delivery times cannot be guaranteed, depending on type, number ordered and stock levels as well as the availability of necessary materials from our suppliers. Bespoke orders may be considerably longer if we have to source rare or scarce stone before we can begin manufacturing your product.
PRICES for delivery in the UK mainland for single planters or pairs are shipped using UPS.
We deliver to anywhere in the UK, although some places in Scotland, Ireland and the Channel Islands will cost extra. Get in touch for a quote. International shipping is negotiable to market forces.
EB Planters will deliver the goods to the location set out in the order or such other location as the parties may agree at a time after EB Planters notifies the customer that the goods are ready.
We organise for any item of ours you buy to be delivered to your door.
Large items are sent on pallets in a lorry, and smaller pieces are picked up by regular couriers. The product will become your responsibility from the time we deliver it to the address you gave us, when you pick it up from us, or a carrier organised by you to collect it from us.
We try our best to make deliveries on days to accommodate you but this is not always possible. This will mean you will need to make arrangements for someone else to check and sign for your delivery. The delivery company will deliver to your address; you will then need to organise any help your side with moving the items into place.
Please inform us in advance if there are any access issues to your site (narrow lanes; muddy fields!), so that we can organise delivery accordingly.
You may be asked to pay for any redelivery charges that are incurred, if you do not let us know in advance.
Please check that your item has arrived with you in good condition before signing for it. *Items signed for in good condition cannot later be replaced as damaged.
Collecting your order in person is by appointment only, but gets a discount and a cuppa.
We want you to enjoy buying from us and aim to make the whole process as friendly and easy as possible.
If you decide you do not want your purchase then contact us immediately. Goods must be returned to us within 14 calendar days, where upon arrival we will inspect the item to make sure it is not damaged and is unused.
You are responsible for all costs of returning the goods and the safety of them.
Goods that have been used and not fit for resale, including any enjoyment you may have already had out of the goods beyond handling them to the extent necessary to establish the nature, characteristics and functioning of them (such as you would, for example, handle a display item in a shop) will not be refunded.
Please note that opening packaging does not prevent you from returning goods, but the item must be repacked securely in its original packaging and protection when returned to us.
EB Planters will seek recompense and make a reduction for loss in value of any goods supplied if the loss is the result of unnecessary handling by you or in a damaged condition. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied in perfect condition.
Within 21 days of the date of delivery, faulty goods will be replaced or refunded.
This policy is invalidated if the goods have been altered in any way from their original condition or if the fault is due to misuse by the purchaser.
Outside of 21 days and up to 12 months from date of delivery, faulty goods will be repaired by the manufacturer. This policy is invalidated if the goods have been altered in any way from their original condition or if the fault is due to misuse by the purchaser.
PLEASE NOTE: custom, bespoke or personalised orders are not covered by the consumer rights directive 2014. This does not affect your statuary rights.
IF THE GOODS ARE DAMAGED IN TRANSIT
You should sign any applicable delivery note to the effect that the goods have been damaged. To return the damaged goods, please contact us immediately to explain the situation and arrange collection and return where we will be responsible for paying shipment costs.
If in the unlikely event of your purchase being damaged en route to you, we will endeavour to rectify the damage, send you a replacement, or give you a refund.
Where you place an order through ebplanters.com for a standard stock product which are not made to your specification you can cancel your order at any time before the goods are posted off to you.
To cancel you must inform us of your decision to cancel your order by a clear statement, including details of your name, geographical address, details of your order you wish to cancel, and your phone number and email address.

If at any time we are unable to accept your order, we will inform you and not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our recourses and suppliers which we could not reasonably plan for, because we have identified an error in the price or description of the product, or because we are unable to meet a delivery deadline you have specified.
EB Planters will not be liable for any misuse or mishandling of their products. Please make sure you read and follow the advice on “How to care for your Planter”.
EB Planters will not be held liable or held responsible for any accidents, injury or death involving any of their products, goods or items.
TERMS OF WEBSITE USE
The customer is responsible for ensuring that the terms for the order submitted by the customer are complete and accurate.
When confirmation of an order is received by the customer from the supplier, this is to indicate that the supplier have received the order. It does not indicate that a contract exists between the parties and the prices and availability of the goods are subject to change without further notice to the customer.
Such terms are there to protect the supplier in the case that a mistake has been made in pricing, including but not limited to having inadvertently under-priced goods or no longer being able to supply particular goods for some reason. In the case of a change of price of the goods, EB Planters will endeavour to contact the customer to ensure that the revised price for the goods is acceptable.
Any samples, drawings, descriptive matter, or advertising produced by EB Planters and any illustrations, photo’s or brochures are produced for the sole purpose of giving an approximate idea of the goods described in them. They shall not form a part of the contract between buyer and supplier or have any contractual force. All specifications, illustrations, colours, drawings and diagrams on EB Planters website including trade literature, catalogues and other published matters are of a generally informative nature and are approximate only. None of these form any part of any contract or give rise to any independent or collateral liability of whatsoever nature on the part of EB Planters and it shall be under no liability whatsoever for inaccuracies, changes or alterations in weights, dimensions or measurements given, quoted or made by EB Planters.
EB Planters reserves the right to amend the specification of the goods if required by any applicable statutory or regulatory requirements.
You must not misuse our site or any part of the service by introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.
If we fail at any time to insist upon strict performance of any of your obligations under these Terms and Conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under them, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
If any of these customer terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition, or provision will to that extent be severed from the remaining terms, conditions and provisions, which will continue to be valid to the fullest extent permitted by law.
Neither party shall be liable for any failure or delay in performing its obligations under the contract to the extent that such failure or delay is caused by a Force Majeure Event. A Force Majeure Event means any event beyond a party’s reasonable control, which by its nature could not have been foreseen, or, if it could have been foreseen, was unavoidable, including strikes, lock-outs, or other industrial disputes(whether involving its own workforce or a third party’s), failure of energy sources or transport network, acts of God, war, terrorism, riot, civil commotion, interference by civil or military authorities, national or international calamity, armed conflict, malicious damage, breakdown of plant or machinery, nuclear, chemical or biological contamination, sonic boom, explosions, collapses of building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, natural disasters or extreme adverse weather conditions, or default of suppliers or subcontractors.

We are the owners or the licensee of all intellectual property rights in our website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
Arrangement for the purchases of goods or services through our site shall be governed by English law. Any dispute arising from, or related to, such contracts shall be subject to the exclusive jurisdiction of the courts of England.
